Welcome to Bramble Bush Bay (the "Site"). This Site is owned and operated by Clare Walsh ("we," "us," or "our").

Please read these Terms of Service ("Terms") carefully before accessing or using our Site or purchasing our downloadable work packs and merchandise. By visiting our Site and/or purchasing something from us, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you may not access the website or use our services.

1. Eligibility & Use by Adults

Our products are designed for use by young children, but our Site and products are intended for purchase only by adults (parents, guardians, educators, and tutors).

  • By purchasing our products, you represent that you are at least 18 years old.

  • Any use of our educational materials by a child should be done under the supervision of a responsible adult.

2. Intellectual Property & Limited License (Digital Downloads)

All downloadable work packs, digital materials, text, graphics, logos, images, and embedded or linked video content (including video introductions and support videos) are the sole intellectual property of Bramble Bush Bay and are protected by copyright laws.

When you purchase a digital work pack, we grant you a limited, non-exclusive, non-transferable license to use the materials under the following conditions:

  • Permitted Use: You may download, print, and use the work packs and access the accompanying video content solely for your own personal, non-commercial, or household use (e.g., teaching your own children/grandchildren).

  • Prohibited Use: You MAY NOT:

    • Share, email, distribute, or forward the digital files or video links to other families, friends, or colleagues.

    • Resell, copy, modify, or sub-license the materials for commercial gain.

    • Upload the files or video content to any public or shared network, cloud drive, or website.

  • Classroom/Tutoring Use: If you are a teacher or tutor wishing to use these materials for multiple students outside a single household, you must purchase a school/commercial license. Please contact us at hello@bramblebushbay.co.uk for details.

3. Video Content & Support Links

Certain work packs include access to video introductions and instructional support hosted on third-party platforms (e.g., YouTube, Vimeo, Squarespace).

  • Access: Access to these videos is included with your purchase. However, we do not guarantee that the video hosting platforms will be 100% uninterrupted or error-free.

  • Protection of Links: You must keep any access links or passwords provided to you confidential and not share them with third parties.

  • Modifications: We reserve the right to update, replace, or modify the video content at any time to improve educational quality.

4. Purchasing & Payment Processing via Paddle

Our store is hosted on Squarespace. However, we use Paddle as our Merchant of Record for payment processing.

  • When you buy a product, your transaction is processed by Paddle, and you will be subject to Paddle’s terms and conditions in addition to ours.

  • Paddle handles sales tax (VAT/GST/Sales Tax) calculations and secure payment handling. We do not store or have access to your financial credit card details.

  • We reserve the right to refuse or cancel any order at our sole discretion.

5. Refunds & Cancellations

  • Digital Downloads & Videos: Due to the nature of digital products, once a work pack is purchased and the download link or video link is delivered, all sales are final and non-refundable. Under GDPR and EU/UK Consumer Law, by purchasing, you explicitly consent to the immediate supply of the digital content and acknowledge that you lose your 14-day right of withdrawal.

  • Physical Merchandise (T-shirts, Mugs): If your physical merchandise arrives damaged, defective, or misprinted, please contact us within 14 days of delivery at hello@bramblebushbay.co.uk with photographic proof, and we will arrange a replacement or refund.

6. Educational & Safety Disclaimer

  • No Guarantees: Our work packs and videos are designed to support early learning. However, every child learns differently. We make no guarantees regarding specific educational outcomes, developmental milestones, or academic performance resulting from the use of our materials.

  • Safety Notice: While our digital materials are educational, any physical activities, crafts, or cutting tasks suggested within the work packs must be strictly supervised by an adult to ensure child safety.

7. Limitation of Liability

To the maximum extent permitted by law, Bramble Bush Bay shall not be liable for any direct, indirect, incidental, or consequential damages arising out of your use of, or inability to use, the Site, the digital work packs, the videos, or the physical merchandise. This includes, but is not limited to, web browser incompatibility or internet disruption preventing video streaming.

8. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the United Kingdom.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check our website periodically for changes.
